Netherlands regulator fines TOTO Online €400,000 for irresponsible marketing

The Dutch Gaming Authority (Ksa) has imposed a fine of 400,000 euros on Toto Online. Toto Online targeted advertising at young adults (18-23 year olds). That’s prohibited.

The Ksa has established that Toto Online sent advertising messages to its entire customer base from October 1, 2021 (the date on which the legal market for online games of chance opened) to February 1, 2022. In addition, advertising, including bonus offers, was also sent to young adults. The gambling provider should not have done that. It is prohibited to send advertising to young adults. Toto Online ceased the violation as of February 1, 2022.

René Jansen, chairman of the Ksa: ‘The law says that vulnerable groups, including young adults, must be given extra protection. The brains of young people are still developing. As a result, they are extra vulnerable to developing gambling addiction. Gaming providers must fully respect the rules intended to protect vulnerable groups. That didn’t happen here and that’s why this fine.’
