Netherlands gambling regulator issues warning to online operator over director appointment

The Dutch Gaming Authority (Ksa) has informed one of its license holders that it would receive a binding instruction if a newly appointed director remained active.

This person did not pass the Ksa’s reliability test due to involvement in an illegal offer in a previous position, and as far as the Ksa is concerned, may therefore not be involved in the provider’s policy.

The person in question has now been fired. It is the first time that the Ksa has imposed such a notice of deportation on an online gaming provider.

Gaming providers with a license must inform the Ksa of changes in the board or other persons who help determine the company’s policy. Following such a change, the integrity of a new co-policymaker is tested. Antecedents are examined, for example (previous) relationships with companies that offer illegal gambling or other relevant violations or criminal activities.

The Ksa emphasizes that it is the provider’s responsibility to adequately investigate the integrity of new directors and co-policymakers. If an investigation by the Ksa shows that the reliability of a director is not beyond doubt, the Ksa will take enforcement action.
