Netherland Gambling Authority finds AML failings at Holland Casino

In 2019, the Netherlands Gambling Authority (Ksa) issued an instruction to Holland Casino because it was not properly complying with certain provisions of the Money Laundering and Terrorist Financing (Prevention) Act (Wwft).

Investigations by the Ksa showed that Holland Casino was, among other things, insufficiently checking the gaming behaviour of players and the origin of the money used.

According to the Wwft, this is required. The Netherlands Gambling Authority (Ksa) therefore issued an instruction at the time with the instruction to get compliance with the Wwft in order. Holland Casino complied with all the given guidelines within the deadlines set at the time.

When publishing the instruction and the decision on the objection, the ruling of the Trade and Industry Appeals Tribunal of 26 March 2024 (ECLI:NL:CBB:2024:223 (referring to another website)) was taken into account.

With the ruling of the CBb, the instruction is irrevocable and is therefore made public. In addition to the instruction, the decision on the objection that was directed against the instruction is also made public. Now that the appeal of Holland Casino has been partly declared well-founded by the CBb, this has led to an adjustment of the instruction to be made public and of the decision on objection taken on it, in the sense that parts of it that the declaration of the appeal is well-founded relates to, will not be made public.

The publication decision itself will not be made public, because it falls under the confidentiality obligation of the Wwft. The publication of this instruction is important for several reasons: This allows the wider public to take note of the (enforcement) actions of the Ksa and the reasons for thisOther providers can take note of behavior that can lead to enforcement It can discourage other providers from violating the Wwft; it has a preventive effect.
