Oklahoma lawmakers veto ban on sweepstakes

Oklahoma legislators have taken decisive action against sweepstakes casinos, successfully overriding Governor Stitt’s veto of Senate Bill 1589 on the final day of the 2026 legislative session.

With a strong bipartisan effort, the Senate voted 34-10, and the House followed suit with a 68-19 vote, bringing the measure into law.

While online casino gambling has long been deemed illegal in Oklahoma, sweepstakes casino platforms have navigated a complex legal landscape by providing free-to-play options and purchasable virtual currencies.

SB 1589 effectively eliminates this loophole by outlawing online casino-style games that involve “representatives of value,” which encompasses the token-based dual-currency models frequently employed by sweepstakes operators. Importantly, this legislation also safeguards tribal gaming activities under the Indian Gaming Regulatory Act (IGRA), ensuring that duly authorized tribal casinos remain unaffected by these new regulations.

The implications of this law are significant: operating or facilitating sweepstakes casino games in Oklahoma is now classified as a felony. Those found in violation face fines between $500 and $2,000 and could potentially face imprisonment.

This development signals a considerable challenge for the sweepstakes casino sector in the U.S. Operators who depended on dual-currency systems to sidestep traditional gambling laws must now exit the Oklahoma market. By specifically addressing online casino-style games that utilize virtual tokens or similar “representatives of value,” the new law categorizes sweepstakes casino models as illegal gambling under Oklahoma law.
