German TV watchdog unveils national gambling advertising rules
Self-regulation to ensure proportionate nationwide TV advertising for online casinos permitted by Schleswig-Holstein can begin.
The Ministry of the Interior, Rural Areas, Integration and Equality of the State of Schleswig-Holstein accepts the rules developed by the German Association for Telecommunications and Media ( DVTM ) and the Central Association of the German Advertising Industry (ZAW) and the associated review process.
“The Schleswig-Holstein gambling regulation allows nationwide advertising of the online casinos approved by the federal state in order to ensure adequate channeling of the authorized players from Schleswig-Holstein. However, the advertising must be both proportional and appropriate to the regional advertising on site. This is what the self-regulation mechanism stands for, on a transparent and verifiable basis, ”summarizes Dr. Bernd Nauen, General Manager of the ZAW.
The procedure carried out by the members of the DVTM concretizes the requirement of the adequacy of their advertisements broadcast on nationwide TV in relation to the advertisements broadcast in regional media in Schleswig-Holstein. The methodology on which the rules are based and the associated monitoring process create predictable conditions for advertising in the federal broadcasting landscape, with which the corresponding objectives of the gaming regulation are taken into account.
For the permitted offers listed in the whitelist of the Schleswig-Holstein Gaming Authority, the following advertising scope is available on nationwide TV:Nationwide advertising is only shown by licensees who also broadcast advertising in regional media in Schleswig-Holstein.
The advertising broadcast by the individual licensee on nationwide TV must be appropriate in relation to the advertising for online casinos broadcast by this licensee in regional media in Schleswig-Holstein. Adequate means that the number of advertising minutes broadcast by the individual licensee on TV that can be received nationwide must not exceed the number of advertising minutes spent by this licensee in regional media in Schleswig-Holstein for online casinos.
The total number of available TV advertising minutes on nationwide TV (around 2.9 million minutes) stands in relation to the advertising minutes share for the offers permitted by law in Schleswig-Holstein and is also – according to the Königstein key – on the population share of Schleswig-Holstein reduced. All offers in the whitelist are then available on TV nationwide for a maximum of 17,000 minutes per month for advertising online casinos.
The recording and calculation of advertising minutes is based on neutral, collected media data. The resulting reporting is available to the gaming regulator in Schleswig-Holstein for taking regulatory steps.
