Kalshi starts restricting access in Washington

Kalshi is navigating a significant regulatory hurdle after a ruling from a Washington state judge mandated the company to significantly limit its operations.

This ruling necessitates that Kalshi cease offering a wide array of event contracts to users in Washington, escalating an ongoing legal confrontation regarding the classification of prediction markets. The core issue revolves around whether these markets should be governed as federally regulated financial products or viewed as gambling activities under the jurisdiction of individual states.

This development holds particular significance as Kalshi operates under the oversight of the Commodity Futures Trading Commission (CFTC). The company insists that its event contracts are aligned with federal commodities laws, thus maintaining that state gambling regulations should not impose conflicting restrictions.

The recent ruling was issued by King County Superior Court Judge John McHale, building on an earlier preliminary injunction from July. Judge McHale determined that there is a strong likelihood that Kalshi is infringing on Washington’s gambling laws, prompting him to instruct the company to drastically reduce the markets it offers to state residents. The imposed restrictions encompass contracts related to various sectors, including sports, elections, politics, entertainment, culture, technology, and science.
