Australia to introduce opt-out system for online gambling ads

The Albanese government will introduce an opt-out register for those who want to avoid all online gambling advertising, with a new tax on wagering companies to fund it.

The Wagering Advertising Opt-out Register will “provide a single mechanism through which individuals may opt out of receiving wagering advertising from online content service providers”.

The government will also add a raft of further amendments to its gambling reform bill, which it expects to pass through both houses this week.

The planned changes include the restriction of “inducement-based marketing”; the requirement for wagering service providers to identify at-risk customers; prohibiting commission-based referrals; and imposing stricter record-keeping and compliance obligations.

“The government has listened carefully to the evidence presented during the recent Senate inquiry and through ongoing stakeholder engagement. We are particularly concerned by evidence about wagering inducements and the role these practices can play in encouraging gambling and exacerbating gambling-related harm.”

Wells said the reforms will “respond to these concerns by introducing new restrictions on inducement-based marketing and establishing the Wagering Advertising Opt-Out Register, which will provide Australians with a one-stop shop to opt out of seeing wagering advertising on online platforms.”

The Australian Communications and Media Authority will establish the register, and will be responsible for monitoring compliance, and enforcement.

Under the government’s draft legislation, announced in April, all online wagering advertising will be banned unless the platform offers a login-profile, age verification systems, and an opt-out function.

All television gambling ads will be restricted to three an hour between 6am-8.30pm, with all ads banned during live sporting broadcast until 8.30pm.

Radio ads are banned during school drop-off and pick-up hours, all in-stadium advertising is banned, while celebrities and athletes are restricted from promoting wagering.
