The MLB Players Association informed Congress that it is willing to consider new restrictions that would prevent players from engaging in personalised marketing campaigns linked to VIP or tier programs.

This communication comes in response to a letter from Sen. Richard Blumenthal (D-CT) and U.S. Reps. Paul Tonko (D-NY) and Valerie Foushee (D-NC), which addressed a personalized video featuring Bryce Harper that was shared with a FanDuel VIP bettor. Although FanDuel responded to the lawmakers earlier in the month, they largely left Congress’s questions unanswered.

Rep. Tonko expressed dissatisfaction with the responses during a recent discussion with LSR, stating that FanDuel appears to be “incapable and unwilling to protect their customers.” In a detailed letter written by General Counsel Jeffrey Perconte, the MLBPA tackled each of the five questions posed by Congress, aiming to provide clarity that FanDuel did not offer.

Additionally, the MLBPA advocated for other measures to promote responsible gambling. Before addressing the questions directly, the MLBPA shared context regarding its ongoing efforts, clarifying several key aspects.

They reaffirmed their support for endorsements between players and sports betting companies while expressing openness to enforce certain prohibitions concerning VIP customers.

Perconte noted, “We are also open to CBA restrictions prohibiting players from participating in personalized marketing campaigns aimed at VIPs, and we will of course continue to encourage our members to support marketing initiatives that promote responsible betting and addiction resources for those in need.”

The MLBPA acknowledged that the existing policy does not specifically mention or address the “predatory VIP programs” referenced in the August 10th letter from Congress. Under the MLBPA’s Sports Betting Policy, players are permitted to leverage their name, image, and likeness for promotional or endorsement activities, yet they are prohibited from advising or promoting any betting related to baseball games or events.
